The case Karen Dillaman v. NCL (Bahamas) Ltd. (Case No. 1:25-cv-21214) involves a negligence lawsuit filed by Karen Dillaman, a resident of Pennsylvania, against Norwegian Cruise Line (NCL). The lawsuit alleges that Dillaman suffered serious injuries after tripping over a misplaced lounge chair on Deck 11 of the Norwegian Jade during a Caribbean cruise.

Background of the Case

On June 8, 2024, Dillaman and her husband embarked on a seven-day Caribbean cruise aboard the Norwegian Jade from Port Canaveral, Florida. The next day, while walking on Deck 11, Dillaman tripped and fell over the leg of a chaise lounge chair, which was positioned in the middle of a narrow walkway area.

According to the complaint:

NCL positioned two rows of chaise lounge chairs in a hazardous manner, creating a tripping hazard for passengers.

Alternatively, NCL allowed passengers to move lounge chairs into the walkway, leading to unsafe conditions.

The hazard existed long enough that NCL knew or should have known about the dangerous condition.

As a result of the fall, Dillaman suffered bodily injury, pain and suffering, disability, mental anguish, and medical expenses.

Allegations Against Norwegian Cruise Line

Dillaman’s lawsuit accuses NCL of negligence by:

1. Failure to Maintain a Safe Walkway

NCL improperly positioned lounge chairs in a narrow walkway, creating an obstruction.

The cruise line failed to ensure that passengers did not move chairs into walking areas.

2. Failure to Warn Passengers of the Hazard

No warning signs or barriers were placed near the obstructed area.

NCL’s crew members failed to correct the hazard, despite its visibility.

3. Negligence Based on Foreseeability

The complaint alleges that this type of hazard is foreseeable, given the layout of the deck and passenger movement.

The lawsuit argues that NCL should have had policies in place to prevent chairs from being moved into unsafe positions.

Legal Implications and Industry Safety Standards

This lawsuit raises key questions about cruise ship safety and passenger protection. Some of the main issues include:

Should NCL be held liable for failing to maintain clear and safe walking paths on its decks?

Does NCL have a history of similar trip-and-fall incidents related to deck chair placement?

Should cruise lines implement stricter policies to prevent trip hazards in high-traffic areas?

What’s Next?

The case will likely focus on:

Whether NCL had prior knowledge of the hazard and failed to take corrective action.

If the failure to warn passengers directly contributed to Dillaman’s injuries.

Whether NCL’s deck layout and maintenance policies meet industry safety standards.
