According to the lawsuit, Packan was late for a scheduled shore excursion in Progreso, Mexico, and was being escorted by a Margaritaville crew member who allegedly rushed him down the stairs at an unsafe pace. While descending the staircase, Packan slipped and fell due to a combination of the crew member’s hurried guidance and dangerous conditions on the stairs. The complaint claims that no warning signs were posted to alert passengers to proceed with caution.
The lawsuit highlights design defects and unsafe conditions, including insufficient rise and tread depth, slippery surfaces, a single handrail instead of two, and uneven metal nosing on the stairs. Packan alleges that these deficiencies made it impossible to safely descend while being hurried by the crew.
