Carnival Cruise Line Sued Over Wet Floor Accident Leading to Knee Injury on Carnival Horizon
Maria Ortega, a Florida resident, has filed a maritime personal injury lawsuit against Carnival Corporation in the Southern District of Florida. The lawsuit, filed under Case No. 1:25-cv-23264, alleges that Ortega suffered severe injuries, including a fractured knee requiring surgery, after slipping on a wet and unmarked floor near a bathroom exit leading to the pool deck aboard the Carnival Horizon on February 15, 2025.
Carnival Horizon Visitor Injured After Slipping on Wet, Slick Floor With No Warning Signs
According to the complaint, Ortega was onboard the Carnival Horizon as an invited guest with a one-day visitor pass for Carnival employees when the incident occurred. She alleges that while walking outside a bathroom near the pool area, she encountered an unreasonably slick and wet surface that lacked any warning signs or slip-resistant treatment. As she stepped onto the surface, Ortega slipped and fell, sustaining a serious knee injury that required surgical intervention.
The lawsuit claims that Carnival failed to post visible caution signs, failed to ensure that the area was kept dry, and did not provide adequate safety measures to prevent falls in a location where water accumulation was foreseeable due to pool traffic.
Carnival Accused of Negligence in Floor Safety, Employee Training, and Emergency Response
The complaint asserts that Carnival had both actual and constructive knowledge of the wet and slippery conditions but failed to address the hazard. Ortega’s legal team argues that Carnival neglected to inspect the area regularly, failed to implement safe operational procedures, and did not adequately train staff to monitor and maintain walking surfaces around the pool and bathrooms.
Furthermore, the lawsuit highlights deficiencies in Carnival’s emergency response. Ortega alleges that after her fall, the cruise line failed to provide immediate medical assistance, did not offer a wheelchair, and forced her to walk off the vessel despite her visibly injured leg, which exacerbated her pain and suffering.
Lawsuit Seeks Compensation for Medical Costs, Lost Wages, and Punitive Damages
Ortega claims that Carnival’s negligence resulted in significant physical and emotional harm, including pain, mental anguish, permanent impairment, and loss of enjoyment of life. The lawsuit seeks compensation for past and future medical expenses, lost wages, diminished earning capacity, and punitive damages due to Carnival’s alleged willful and reckless disregard for passenger safety.
