MSC Seascape Slip and Fall Lawsuit: Florida Woman Claims Injury in Hall of Games Near Aquapark
Amber Bradby, a Florida resident, has filed a maritime personal injury lawsuit against MSC Cruises, S.A. in the Southern District of Florida. The lawsuit, filed under Case No. 0:25-cv-61489-AHS, alleges that Bradby sustained serious injuries after tripping over a wet floor caution sign in the Hall of Games arcade aboard the MSC Seascape on August 22, 2023.
Cruise Passenger Injured in Hall of Games After Crew Placed Wet Floor Sign Without Warning
According to the complaint, Bradby and her husband were playing air hockey in the ship’s Hall of Games arcade, located near the Pirates Cove Aquapark, when a crew member placed a wet floor caution sign directly behind her during the game. Bradby alleges she was not warned of the sign’s placement and could not see it while focusing on her game. As she turned to leave, she tripped over the sign and slipped on the wet and slippery floor surrounding the area, causing her to fall and sustain serious injuries. The lawsuit claims that the combination of the tripping hazard and slick floor created an unreasonably dangerous condition for passengers.
MSC Accused of Failing to Maintain Safe Walking Surfaces and Warn Passengers
The lawsuit asserts that MSC Cruises failed to properly inspect and maintain the walking surfaces in and around the Hall of Games, despite company policies requiring prompt cleanup of wet or slippery areas near aquatic attractions. Bradby’s legal team argues that the cruise line had both actual and constructive knowledge of the dangerous conditions but failed to take appropriate corrective measures. The complaint cites multiple prior slip and fall cases aboard MSC vessels, including incidents on the MSC Seaside and MSC Meraviglia, to show a pattern of similar hazards across the cruise line’s fleet.
Complaint Highlights Unsafe Conditions Near Pirates Cove Aquapark and Poor Risk Management
Bradby alleges that the Hall of Games was improperly designed and maintained, particularly given its proximity to the Pirates Cove Aquapark, where wet floors are foreseeable. The complaint states that MSC failed to utilize non-slip flooring, failed to monitor and dry wet surfaces, and failed to cordon off hazardous areas. It also alleges inadequate risk management policies, insufficient crew training, and poor enforcement of safety protocols, all of which contributed to Bradby’s accident.
Plaintiff Seeks Damages for Permanent Injuries, Medical Costs, and Lost Wages
Bradby’s lawsuit brings multiple counts of negligence, including negligent maintenance, negligent failure to warn, and general negligence. She claims that MSC breached its duty of reasonable care by failing to provide a safe environment for passengers. As a result of the fall, Bradby alleges she suffered significant injuries to her lumbar spine, left hip, and left leg, as well as pain, emotional distress, and loss of earning capacity. She also seeks damages for past and future medical expenses and the loss of value of her disrupted cruise vacation.
