Texas Passenger Sues Carnival Cruise Line After Slip and Fall on Wet Lido Deck Near Guy’s Burger Joint Aboard Carnival Breeze
Charmene Hall, a resident of Texas, has filed a maritime personal injury lawsuit against Carnival Corporation in the U.S. District Court for the Southern District of Florida. The complaint alleges that Hall suffered serious knee and hip injuries after slipping on a wet surface on the Carnival Breeze’s lido deck near Guy’s Burger Joint on June 19, 2024.
Cruise Passenger Claims Wet Deck Surface Lacked Warnings and Slip-Resistant Features
According to the lawsuit, Hall was walking in a high-traffic food service area on the lido deck when she stepped on a transitory liquid substance, lost her footing, and fell. She alleges that the deck surface was made of a material that became dangerously slippery when wet, particularly in a location where food and drinks were routinely carried. The complaint states that no warning cones, signage, or barriers were in place before her fall, and that crew members began cleaning the spill only after the incident occurred.
Carnival Accused of Negligent Maintenance, Inspection, and Design of Lido Deck Surface
Hall’s lawsuit claims Carnival had both actual and constructive knowledge of the dangerous condition through its daily operations, prior similar incidents, and the obvious risk of spills in the lido deck dining area. She alleges the cruise line failed to regularly inspect the deck for hazards, did not promptly clean the liquid, and failed to implement adequate spill-prevention measures.
In addition to maintenance failures, the complaint alleges negligent design and installation, claiming Carnival selected flooring with insufficient slip resistance for a food court environment and failed to use mats, textured surfaces, or other safety features to reduce the risk of falls.
Complaint Highlights Prior Similar Slip and Fall Incidents on Carnival Ships
The filing references multiple other lawsuits in the Southern District of Florida involving passengers slipping in similar high-traffic, wet-prone areas aboard Carnival vessels. Hall’s legal team argues that these prior cases demonstrate Carnival’s awareness of the hazard and its ongoing failure to adopt fleetwide safety improvements.
Plaintiff Seeks Damages for Permanent Injuries, Medical Expenses, and Loss of Enjoyment of Life
Hall alleges she suffered a medial collateral ligament sprain and partial meniscus tear in her right knee, a torn meniscus in her left knee, and hip pain, all of which have required medical treatment and will have lasting effects. She seeks damages exceeding $75,000 for pain and suffering, disability, loss of enjoyment of life, lost wages, diminished earning capacity, and past and future medical expenses. The lawsuit demands a jury trial on all issues so triable.
