California Woman Sues Carnival Cruise Line After Showerhead Falls on Her Face Aboard Carnival Paradise
Tanya Morgan, a California resident, has filed a maritime personal injury lawsuit against Carnival Corporation in the Southern District of Florida. The lawsuit, filed under Case No. 1:25-cv-25341, arises from an incident on September 17, 2024, when Morgan was allegedly injured by a detached showerhead that fell on her face while she was showering in her stateroom aboard the Carnival Paradise.
Cruise Passenger Injured by Falling Showerhead in Bathroom Aboard Carnival Paradise
According to the complaint, Morgan was a fare-paying passenger aboard the Carnival Paradise when she was using the bathroom in her stateroom. While taking a shower, the showerhead suddenly detached from the wall and struck her head and face. The lawsuit claims that the incident caused Morgan to suffer serious physical injuries.
The plaintiff asserts that Carnival had a duty to maintain the bathroom fixtures in a reasonably safe condition and that its failure to do so resulted in the dangerous condition that led to the accident. Morgan argues that the cruise line’s stateroom maintenance crew was responsible for inspecting and securing bathroom fixtures and that their failure to detect and repair the loose showerhead constituted negligence.
Lawsuit Alleges Carnival Knew or Should Have Known About Dangerous Bathroom Condition
Morgan’s lawsuit includes claims of vicarious liability for both failure to maintain and failure to warn. In her complaint, she argues that the cruise line, through its employees and agents, had actual or constructive knowledge of the loose or faulty showerhead. The danger was allegedly not open and obvious, meaning passengers would not reasonably notice or anticipate it on their own.
She further alleges that Carnival failed to provide any warning about the showerhead hazard, either through verbal notice, visible signage, or pre-cruise maintenance alerts. The lack of notice, coupled with the alleged failure to repair the defect, is the basis for the claim that Carnival breached its legal duty of care to a passenger lawfully aboard the vessel.
Plaintiff Seeks Damages for Facial Injuries, Pain, and Loss of Enjoyment of Cruise
As a result of the accident, Morgan claims to have sustained injuries to her face and head, resulting in pain, emotional distress, and disruption of her cruise vacation. She is seeking compensatory damages, including the cost of medical care, loss of enjoyment, and other economic and non-economic damages. The complaint demands a jury trial on all issues.
Her legal team at Chalik & Chalik, P.A. asserts that the value of the claim exceeds $75,000, invoking diversity and admiralty jurisdiction under federal law.
