Florida Woman Sues Carnival Cruise Line After Slip and Fall Near Hot Tub on Carnival Freedom
A Florida resident has filed a maritime personal injury lawsuit against Carnival Corporation in the Southern District of Florida, alleging she was seriously injured after slipping on a wet and slippery platform near a hot tub aboard the Carnival Freedom. The complaint, filed under Case No. 1:25-cv-24752, asserts that Carnival was negligent in maintaining the poolside platform area and failed to warn passengers about the hazardous condition.
Passenger Injured on Wet Pool Deck Platform While Accessing Carnival Freedom Hot Tub
According to the lawsuit, the incident occurred on November 6, 2024, while plaintiff Brandi Miller was a paying guest aboard the Carnival Freedom. Miller alleges that she slipped and fell on a slick surface near a hot tub while stepping onto a platform that had been left wet and dangerously slippery. The area, the complaint claims, was not marked with warning signage and had not been dried or maintained in a reasonably safe condition by Carnival’s crew.
Miller contends that she was lawfully using the hot tub facilities when the accident occurred and had no way of knowing the platform posed a hazard. She asserts that Carnival’s failure to inspect, maintain, or caution against the wet surface directly caused her fall and resulting injuries.
Carnival Accused of Failing to Maintain Safe Pool Deck Conditions or Warn of Known Hazards
The lawsuit alleges that Carnival breached its duty of care under general maritime law by allowing wet and slippery conditions to exist near a high-traffic passenger amenity. Specifically, the complaint claims the cruise line failed to inspect the area, dry or secure the platform, or post caution signs warning of the risk of slipping. It further argues that such conditions were foreseeable, given the proximity to the ship’s hot tub and water-related activities.
Miller claims that Carnival either knew or should have known of the hazard and that the dangerous condition existed long enough to be discovered through reasonable care. The complaint emphasizes that wet decks near pools and hot tubs are common risk areas on cruise ships, making inspection and upkeep a critical part of passenger safety procedures.
Plaintiff Alleges Long-Term Injuries, Medical Expenses, and Loss of Enjoyment of Life
As a result of the fall, Miller alleges she suffered serious bodily injuries, including physical pain, disability, and disfigurement. The complaint also lists emotional distress, aggravation of a pre-existing condition, and loss of capacity for the enjoyment of life as damages. She claims to have incurred expenses for medical care and treatment and asserts she may continue to experience losses in the future due to the lasting impact of her injuries.
Miller is seeking a jury trial and demands damages in excess of $75,000 for medical bills, lost wages, reduced earning capacity, and other related losses stemming from the incident.
