Florida Woman Sues Norwegian Cruise Line for $10 Million After Sexual Assault by Crew Member on Norwegian Jade
Vivian Perez has filed a maritime personal injury lawsuit in the Southern District of Florida against NCL (Bahamas) Ltd., alleging that she was sexually assaulted by a crew member aboard the Norwegian Jade during a cruise departing from Port Canaveral. Passenger Alleges Cruise Line Crew Member Committed Assault in Private Area of Ship
According to the complaint, the incident occurred on June 13, 2024, while Perez was traveling with her family. The assailant, a crew member employed by Norwegian Cruise Line and identified in the complaint as Pablo, allegedly lured the plaintiff away from a public area near the pool deck into a private projection room. Once inside, Perez claims Pablo groped her, attempted to gain access to her underwear, and assaulted her despite her repeated verbal objections and physical resistance. She was ultimately able to push him away and flee.
Cruise Passenger Claims NCL Crew Ignored Her Report of Sexual Assault and Failed to Act
After the incident, Perez states she approached guest services and attempted to report the sexual assault to a crew member named Flavio. According to the complaint, she was told that there was no one available to help her and was directed instead to write down what happened and place her statement in a suggestion box. When she asked Flavio to call ship security or police, she alleges she was told that there was “no boat police.” She later contacted the FBI and a victim’s advocate upon her return to Florida.
Complaint Seeks to Hold NCL Vicariously Liable for Employee’s Assault Under Maritime Law
The plaintiff asserts that NCL is strictly liable under maritime law for the actions of its crew member, who was acting within the scope of his employment at the time of the alleged incident.
