Indiana Woman Sues Princess Cruises After Slip and Fall on Wet Floor Near Dining Area Aboard Enchanted Princess
Marsha Peters, a resident of Indiana, has filed a maritime personal injury lawsuit against Princess Cruise Lines, Ltd., in the Southern District of Florida. The complaint, filed under Case No. 1:25-cv-24249-RAR, alleges that Peters suffered serious injuries after slipping on a wet and unmarked floor near the Deck 16 dining area aboard the Enchanted Princess on September 28, 2024.
Cruise Passenger Injured by Wet and Slippery Floor Created by Crew Cleaning Without Warning Signs
According to the complaint, Peters was walking through a heavily trafficked corridor near a dining area on Deck 16 when she slipped and fell on a freshly mopped floor. The lawsuit alleges that the wet surface was created by Princess crew members who were actively cleaning the area but failed to place any warning signs, cones, mats, or verbal advisories to alert passengers of the hazard.
Peters asserts that the wet condition was not visible or obvious to passengers and that there were no markings or indicators that the floor had recently been cleaned. She further claims that the area was being used by both crew and guests as a common path of ingress and egress and that no staff were present to monitor the area or prevent entry during the cleaning activity.
Princess Accused of Creating Dangerous Condition in Violation of International Safety Regulations
The lawsuit alleges that Princess not only created the dangerous condition but did so in a manner that violated international safety regulations. Specifically, Peters’ legal team cites the Safety of Life at Sea (SOLAS) treaty, a binding international maritime safety standard, which requires cruise lines to maintain safe escape routes free from hazards or obstructions.
The complaint references SOLAS Part C, Regulation 13, which mandates that “safe escape routes shall be provided” and “maintained in a safe condition, clear of obstacles.” By allowing cleaning activities to create a slippery floor without proper safeguards in an area used as an escape route, the lawsuit argues that Princess committed negligence per se.
Lawsuit Alleges Failure to Warn, Maintain, or Follow Slip and Fall Prevention Policies Aboard Enchanted Princess
Peters brings two counts of negligence against Princess: one based on vicarious liability for the actions of crew members and another asserting the cruise line’s direct liability for failure to implement and enforce safety policies. The lawsuit claims Princess failed to follow its own internal protocols for passenger safety during cleaning procedures and did not monitor or restrict passenger access to actively mopped areas.
The complaint also asserts that Princess was aware of the risks posed by wet floors, having experienced prior incidents of passenger slip and falls aboard its vessels, yet continued to allow crew to mop public walkways without adequate warnings. According to the filing, the floor material lacked sufficient traction when wet, and no alternative safety measures were implemented.
Plaintiff Seeks Damages for Back and Knee Injuries, Loss of Earnings, and Diminished Quality of Life
As a result of the fall, Peters claims she sustained injuries to her back and knee, aggravated pre-existing conditions, and has experienced ongoing pain, physical limitations, and emotional distress. The complaint states that her injuries are permanent in nature and have impaired her ability to work and enjoy daily life.
She seeks compensation for medical expenses, lost wages, loss of future earning capacity, pain and suffering, and diminished quality of life. A jury trial is requested on all counts.
