Princess Cruises Sued by Canadian Passenger Struck by Broken Spa Door Mechanism on Cruise Ship
Giorgio Cogrossi, a Canadian citizen, has filed a personal injury lawsuit against Princess Cruise Lines Ltd. following a serious onboard injury aboard a Princess cruise ship on May 22, 2024. According to the complaint filed in the Southern District of Florida under Case No. 1:25-cv-22318-KMW, Cogrossi sustained a concussion and other injuries after being struck in the head by a detached metal door-closing mechanism while attempting to exit the Lotus Spa.
Cruise Ship Spa Door Injury Involved Detached Metal Arm That Struck Passenger in the Head
The lawsuit alleges that while leaving the Lotus Spa facility, Cogrossi pulled open the door using normal force. Due to a failure in the overhead closing mechanism, the door swung open abruptly, causing the detached metal arm to swing like a pendulum and strike him forcefully in the head. The complaint states that the device had exposed nails and posed a visible hazard.
Cogrossi immediately experienced dizziness, confusion, and nausea. Despite his condition, he claims spa staff failed to secure the door or prevent others from using it. When questioned, the staff allegedly admitted that the door had been reported as broken “a while ago” to maintenance, and this was later reiterated to ship security.
Plaintiff Claims Princess Cruise Staff Knew of Defective Door but Failed to Repair or Warn
The complaint alleges Princess Cruises had actual and constructive notice of the dangerous condition. Crew members acknowledged prior reports, and the continued slamming of the broken spa door reportedly produced a loud noise and visible risk that could have been detected by staff assigned to the area.
Despite this, Cogrossi says no signage was posted and no efforts were made to prevent further injuries. The complaint emphasizes that under maritime law, cruise lines are responsible for maintaining shipboard facilities in a reasonably safe condition and warning passengers of known dangers.
Cruise Passenger Diagnosed with Concussion After Spa Door Accident and Emergency Transport to Florida Hospital
Cogrossi was initially denied medical care until he signed legal documents, according to the complaint. He later relented under duress and was diagnosed with a concussion in the ship’s infirmary. On May 27, 2024, he was transported by ambulance to Broward Health Medical Center in Fort Lauderdale, where the diagnosis was confirmed via CT scan.
The lawsuit seeks damages for head trauma, pain and suffering, emotional distress, and medical expenses stemming from the cruise ship spa injury.
