Regent Seven Seas Cruises Sued After Trip and Fall on Deck Chair on Seven Seas Splendor
Richard Tuchman, a Florida resident and frequent cruiser, has filed a maritime personal injury lawsuit against Seven Seas Cruises Ltd., doing business as Regent Seven Seas Cruises. The complaint, filed under Case No. 1:25-cv-25545-DPG, alleges that Tuchman suffered serious injuries after tripping over a misplaced and dangerously designed deck chair aboard the Seven Seas Splendor on September 8, 2024.
Cruise Passenger Trips Over Misaligned Deck Chair With Protruding Legs on Regent Seven Seas Vessel
According to the lawsuit, Tuchman was walking on the pool deck of the Seven Seas Splendor when he tripped over the leg of a lounge chair that was out of alignment with the rest of the chairs. The chair had allegedly been moved out of place and arranged in a hazardous configuration, creating a hidden tripping hazard. In addition, the lawsuit asserts that the deck chairs on the Splendor were structurally different from those Tuchman had encountered on his 15 prior Regent cruises, with more aggressively curved legs that protruded outward from the base of the chair.
As a result of the fall, Tuchman sustained severe physical injuries and alleges that Regent failed to identify or correct the dangerous condition, despite routine inspections and crew monitoring protocols on the pool deck.
Regent Accused of Ignoring Pool Deck Hazards and Failing to Enforce Safety Policies for Lounge Chair Placement
The lawsuit asserts that Regent Seven Seas Cruises failed to maintain clear and safe walking areas by not properly securing, aligning, or affixing its deck furniture. Tuchman’s legal team argues that the cruise line had established safety policies requiring daily inspections of the pool deck area to check for tripping hazards, including chair placement. Despite this, crew members allegedly allowed deck furniture to be misaligned and left unattended in high-traffic zones.
Tuchman also claims that Regent failed to enforce procedures preventing passengers from moving deck chairs into walkways. The complaint cites the cruise line’s duty to prevent such hazards through policies, physical barriers, or crew enforcement.
Lawsuit Points to Prior Similar Incidents on Sister Ships Operated by Norwegian Cruise Line Holdings
Tuchman’s lawsuit includes allegations that Regent was on notice of the dangerous condition due to a history of similar trip-and-fall incidents aboard vessels operated by its parent company, Norwegian Cruise Line Holdings.
Each case involved a passenger tripping over a lounge chair that was either misaligned or designed in a way that posed a tripping hazard. Tuchman alleges these incidents provided Regent with actual or constructive notice of the risks posed by similar furniture arrangements and designs.
The complaint further asserts that Regent has since removed the same style of curved-leg deck chairs from its fleet, which Tuchman alleges is evidence of acknowledgment that the furniture design was unsafe.
Complaint Brings Four Negligence Counts for Failure to Maintain, Warn, and Supervise Deck Chair Placement
Tuchman brings four counts against Regent: general negligence, negligent failure to warn, negligent failure to maintain, and vicarious liability for crew negligence. He claims Regent failed to warn passengers of the chair’s unusual design, failed to secure furniture in walkways, and failed to inspect or supervise passenger movement of chairs.
Tuchman also alleges the crewmembers assigned to the pool deck negligently failed to inspect, report, or correct the dangerous chair configuration, leaving the chair in a location that created a foreseeable tripping hazard.
Plaintiff Seeks Compensation for Permanent Injuries and Loss of Cruise Enjoyment Due to Regent’s Alleged Negligence
As a result of the incident, Tuchman claims to have sustained permanent injuries, physical pain, mental anguish, disfigurement, and diminished mobility. He is seeking damages for medical costs, future care, and the loss of enjoyment of his cruise vacation. The lawsuit also alleges the injuries have impaired his ability to lead a normal life and that the effects of the accident are permanent or continuing.
