Texas Passenger Sues Carnival Cruise Line After Tripping on Unsafe Workout Equipment Near Running Track on Carnival Breeze
Randal Torres, a resident of Texas, has filed a maritime negligence lawsuit against Carnival Corporation in the Southern District of Florida. The lawsuit, filed under Case No. 1:25-cv-22723, alleges that Torres suffered a fractured ankle after tripping on poorly placed workout equipment installed dangerously close to the jogging track aboard the Carnival Breeze.
Cruise Passenger Trips on Fitness Equipment Installed Too Close to Deck 12 Running Track on Carnival Breeze
According to the complaint, the incident occurred on April 18, 2024, while Torres was jogging on the designated running track located on Deck 12 of the Carnival Breeze. Carnival had installed multiple pieces of metal workout equipment, including poles and resistance machines, immediately adjacent to the narrow jogging path. The lawsuit alleges that the equipment was bolted in place with protruding parts encroaching on the track, creating an unreasonable risk of tripping.
While jogging, Torres’ foot struck a protruding component of the equipment, causing him to trip and fall violently onto the deck. As a result, he suffered a fractured left ankle that required surgery and has experienced ongoing pain, limited mobility, and emotional distress.
Lawsuit Claims Carnival Knew of Hazardous Deck Layout But Failed to Inspect, Maintain, or Warn Passengers
The complaint asserts that Carnival negligently designed and maintained the fitness and running track area by failing to provide sufficient clearance, barriers, or warnings for passengers using the jogging path. It argues that Carnival knew or should have known about the hazard because the equipment was installed by its own crew and was used by thousands of passengers daily.
Torres alleges that Carnival failed to inspect the area properly, did not monitor for safety hazards, and provided no warning signs or markings to alert passengers about the proximity of hard-edged metal equipment to the running surface.
Plaintiff Brings Multiple Counts of Negligence for Unsafe Deck Layout and Lack of Safety Warnings
Torres’s lawsuit brings six counts against Carnival: negligent failure to inspect, negligent maintenance, negligent failure to warn, and related vicarious liability claims for the acts and omissions of Carnival’s crew. He claims that Carnival’s crew failed to notice or fix the unsafe placement of the equipment and failed to maintain the jogging track and surrounding fitness area in a reasonably safe condition for paying passengers.
Torres seeks compensation for his medical expenses, ongoing treatment, lost earning capacity, physical and emotional pain, and other damages resulting from the incident.
